One or both parties to a marriage can apply for a divorce if there has been an irretrievable breakdown of the marriage. The only way to establish this is by twelve month's separation. A divorce cannot be obtained faster by alleging that one party has caused the separation.

We can help you if you prefer not to do your own divorce. You may need our help if, for example:

  • you and your spouse have been separated under the one roof
  • you have not sorted out your financial arrangements
  • you are unhappy with the parenting arrangements
  • you do not know how to serve court documents on your spouse

The divorce process usually takes 6 - 10 weeks from the time the Application for Divorce is filed.

It is important to note that after you have been divorced for twelve months, you will need to seek the leave of the court to apply for property or spousal maintenance orders. Ideally, these arrangements should be sorted out before you apply for a divorce.
